HASTINGS, Minn. - A Missouri man is charged with one misdemeanor count of careless driving in connection with a crash that claimed the lives of two highway workers.

Kirk Deamos, age 22, of Raymore, Missouri, was charged in Dakota County by summons.

A criminal complaint says Deamos was on his way from Missouri to Collegeville, Minnesota, the afternoon of October 13, 2011, when he lost control of his vehicle on Interstate 35W near the McAndrews Road Overpass. The 1998 Mitsubishi 3000 GT he was driving spun and left the road, fatally striking Craig Carlson and Ron Rajkowski.

In an interview Deamos told investigators he slowed from the posted 70 miles per hour to 60 miles per hour due to a rerouting of the freeway and the presence of concrete barriers. Deamos told them he looked down for a moment to shut off the cruise control on the Mitsubishi, which he had just purchased two days earlier. When he looked up, Deamos said he thought he was too close to the barriers, overcorrected, and put the car into a spin.

Investigators say tests show that Deamos was not intoxicated or under the influence of drugs, and add that there is also no evidence he was using a cell phone. The car was found to be in good mechanical condition and pavenment conditions were dry at the time of the fatal crash.
