Victim's family claims Minneapolis police planted gun

In the summer of 2006 19-year-old Fong Lee was gunned down by Minneapolis police officer Jason Andersen in north Minneapolis.

Andersen claimed Lee was evading him and was waving a gun while not stopping for over a block while the officer chased him.

So, Anderson shot Lee eight times.

Now, surveillance video released by Rich Hechter, the Lee family attorney shows the end of the chase between Officer Andersen and Fong Lee.

Hechter, along with experts he hired, says the video shows Lee was not carrying a gun during the chase.

Hechter filed an affidavit making this claim in federal court along with other allegations.

In the affidavit Hechter claims police planted a gun near Lee, after he was shot, to make it look like he really did have a gun before being shot by Officer Andersen.

Hechter says in court documents the planted gun was taken from the evidence room at the 4th precinct, the same station officer Andersen worked out of, and placed near Lee's dead body for evidence.

Hechter would not comment on the filings he made today.

Officer Andersen was found to be justified in his shooting of Fong Lee in 2006 by the police department's internal investigation.

Police Chief Tim Dolan also defended Andersen's actions publicly. Adnersen was even given an award for his actions by the department calling his work that day, brave.

Andersen joined the Minneapolis police department in August of 2005 and remains active on the force.

The Minneapolis city attorney, Susan Segal, did say late Wednesday afternoon that the allegations Hechter is making are totally false and that the city will prove it in litigation with evidence.

The city attorney declined an on camera interview saying, "We try our cases in the courtroom, not in the press."
