TUSTIN, Calif. -- A California couple has been arrested after police found dozens of marijuana plants growing in their infant's nursery.
Authorities arrested 29-year old Tina Turrieta and 26-year old Stephen Casino, charging them both with child endangerment.
The couple told police they have a license to grow the pot for their own medicinal use.
Authorities say that's an issue they're still investigating.
Police say they made the arrests because the plants were a clear danger to the baby.
"A 1-year-old can't make any determination about what it puts in its mouth," said Tustin Police Lt. Tom Tarpley. "It's a danger because it could grab the plant and ingest it."
Under California law a licensed patient can possess eight ounces of dried marijuana and up to 12 immature plants, but the state supreme court is still grappling with what should be a "reasonable" amount based on medical need.
