MINNEAPOLIS - A Hennepin County Grand Jury has decided there will be no criminal charges against the Minnetonka Police officers involved in a fatal shooting last fall.
The Grand Jury announced Thursday that officers James Comings and Ryan Smith have been cleared in the shooting death of Michael Tray of Austin. The officers were among those called to 10761 Smetana Road the night of October 23 on reports of a man with a gun.
Once on the scene police say they encountered Tray in the parking garage with a gun in his hand. The confrontation ended with Tray being fatally shot.
"While we've always believed our officers acted appropriately, we know that the grand jury decision doesn't relieve the anguish of the family of Michael Tray," said Minnetonka Police Chief Mark Raquet. "Our officers train and prepare for all kinds of incidents, but a call resulting in a fatality is a scenario no police officer wants to have happen."
The incident was the first officer-involved shooting in the history of the Minnetonka Police Department.
