Eagan mayor charged with DWI

A criminal complaint describes how officers found Michael John Maguire behind the wheel of an SUV that was stuck in a snowbank.

EAGAN, Minn. — The mayor of the largest city in Dakota County is charged with DWI after getting his vehicle stuck in a snowbank.

A criminal complaint filed against 52-year-old Michael John Maguire says Eagan Police squads were dispatched just after 8 p.m. January 11 on reports of an SUV that was stuck near the intersection of Dakota Path and Shadow Creek Curve in Eagan. Responding officers found the car running, and Maguire behind the wheel. 

In speaking with the mayor, officers detected the smell of alcohol, and noticed his speech was slow and slurred, according to the complaint. Prosecutors say Maguire failed one field sobriety test, then refused to perform the rest. Officers on the scene maintain he was swaying and staggering on the way to a squad car.

Maguire was placed under arrest for driving while intoxicated. The complaint states a preliminary breath test registered a blood alcohol content of .19, more than twice the legal limit to drive.    

The case is being handled by Hastings City Attorney's Office to avoid a conflict of interest. 

Eagan's city web page says Maguire served on the Eagan City Council from 2003-2007, until he was elected mayor. He is currently serving his fourth term.
