Mpls. officer to plead not guilty to Justine Damond death

Former Minneapolis police officer Mohamed Noor was released from jail Wednesday night after posting bond.

MINNEAPOLIS - The Minneapolis police officer accused of shooting and killing Justine Damond plans to plead not guilty in the case, according to court documents.

Former officer Mohamed Noor intends to use self defense and an argument for reasonable force in the July shooting of Damond, where he has been charged with third-degree murder and second-degree manslaughter, according to the "Rule 9 disclosure" signed by his lawyer, Thomas Plunkett.

Noor shot 40-year-old Justine Damond in an alley behind her south Minneapolis home last summer, after she called police to report a possible sexual assault.

Documents released by the BCA state that Noor's partner, Matthew Harrity, was startled by a loud sound before Damond approached the driver's side window of the squad. Harrity then told agents that Noor, who was in the passenger seat, shot Damond through the open driver's side window.

Hennepin County Attorney Mike Freeman announced the charges against Noor on March 20, saying, "There is no evidence Officer Noor encountered a threat, appreciated a threat, or confirmed a threat that justified his decision to use deadly force."

Noor was released from jail after posting bond on March 21. His next court date is May 8.
